THE INTENT OF THIS SOURCES SOUGHT IS TO IDENTIFY QUALIFIED SMALL BUSINESSES, including 8(a), HUBZone, woman-owned, and service-disabled veteran-owned small businesses, for the requirement described below. The intent of this Sources Sought is to identify capable small businesses that can perform with limitations on subcontracting. The scope of work requires the transportation and disposal of Resource Conservation and Recovery Act (RCRA) Hazardous wastes, non-RCRA wastes, Batteries, Corrosive waste, Compressed Gas Cylinders, Flammable waste, Demil-required waste, State-Regulated waste, Non-Hazardous Waste, Polychlorinated Biphenyls (PCBs), AFFF and other Per- and Polyfluoroalkyl Substances (PFAS)-related waste, Mandatory Recycling waste, Reactive waste, and Toxic waste in and around Hill AFB, Utah. In addition, special services will be required such as sampling and analysis, industrial cleaning services, lab packs/loose packs, rolloff box rentals, vacuum box rentals, FRAC Tank rentals, and expedited removals and performance. All services necessary for the collection, storage, processing, removal, transportation, final treatment, and disposal of waste must be in accordance with all local, state, Department of Defense, and Federal laws and regulations. In a set aside, FAR 52.219-14 Limitations on Subcontracting (FEB 2023) (DEVIATION 2021-O0008) states the small business Offeror/Contractor agrees to not pay more than 50% of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Note: The FAR references in the clause above are not aligned with the Revolutionary FAR Overhaul (see DEVIATION 2026-O0038); therefore, the following is provided for clarification purposes: references to 19.8 is now 19.105, 9.13 is now 19.106, 19.14 is now 19.107, 19.15 is now 19.108, 8.405-5 is now 8.4, and 16.505(b)(2)(i)(F) is now 16.5. In accordance with 13 CFR 125.6(h), contractors may be subject to a minimum $500,000 fine if awarded a contract with this clause and does not meet the requirement. DLA has identified the majority of RCRA TSDFs (Treatment, Storage, Disposal Facilities) in the industry as large businesses. All TSDFs used during the performance of this contract must be approved and listed on the Qualified Facilities List located at the following website: https://www.dla.mil/DispositionServices/Offers/Disposal/HazardousWaste/HazWasteDisposal/. Given there is a lack of small business ownership of TSDFs and that disposal costs make up a large portion of the contract dollar value, there is a reasonable probability that a small business would pay more than 50% of the cost of the contract to large businesses. *The Government intends to solicit proposals on SAM.gov and award a commercial Firm-Fixed Priced, Indefinite Delivery Indefinite Quantity (IDIQ) Services Contract. The contract is anticipated to have one 30-month base period, followed by one 30-month option period. There is no solicitation availabl…
